Emil Kleinhaus, recently named runner-up for The American Lawyer‘s “Litigator of the Week” for his work leading the Wachtell Lipton team representing Mitel Networks, secured a significant victory for the company in a significant out-of-court debt restructuring.
Following arguments presented by Mr. Kleinhaus before the New York Appellate Division, First Department, in October, the court issued a favorable ruling for Mitel on New Year’s Eve. The court upheld the dismissal of certain breach-of-implied-covenant claims and reversed the lower court’s decision by dismissing the plaintiff’s express contract claims entirely.
The Wachtell Lipton team on the matter also included Michael Cassel, Mitchell Levy, Lauren Kofke, and Kate Waldock.
